Most real property disputes involve claims that certain uses of the property are prohibited or restricted. The restrictions for the use of real property are usually proscribed in a local ordinance, zoning regulations, deed restrictions, or the rules and regulations of a homeowner's association. Restrictive uses may prohibit the parking of a recreational vehicle upon the property, building a shed, or installing a satellite dish. Other restrictions are based on style or decor and may prohibit the use of certain colors for paint, style of roof tile, or the type of driveway you may have. In all instances, the restriction itself should be reviewed to ensure that it was properly recorded and is being properly enforced.
