Florida Small Claims Court is a Court for claims whose value is $5,000.00 or less. Any claims in excess of $5,000.00 must be filed in either the County Court (less than $15,000.00) or the Circuit Court (more than $15,000.00).  Different procedures are used in Small Claims Court than those in the County and Circuit Courts of Florida.  Generally, Small Claims Court will give you a faster result than in the other courts as the cases are moved along faster.

Small Claims Courts are often considered less formal than the County or Circuit Courts.  Many people represent themselves in Small Claims Court and they may do just fine if they know what they are doing.  You are obligated to follow the proper procedures for the Court and it is your responsibility to file proper legal claims or defenses.  It is important to know that neither the Judge nor anyone at the Court can provide you with legal advice or assistance with your case.  As such, if you do not know what you are doing and fail to file the proper papers, claims or defenses you can easily end up losing your case.  The recipe for success in almost anything in life is preparation and that is no different for Small Claims Court.

Recognizing that not everyone can afford to hire a lawyer full-time to handle their case, Russell Law is now offering a unique consult service to clients for Small Claims Court cases. A consult can be used to help you prepare the paperwork and lawsuit for your Small Claims case.  We can also assist in having the lawsuit filed, served and a copy mailed to you so you know when to appear in Court.  Additional consults are available to advise you on what to expect in Court, how to conduct yourself and what you should be prepared to do and say.  In the event that your case does not settle and a trial is required, additional consults can be provided to prepare you for trial or you may also choose to hire us to handle the trial for you.  How much or little we are involved in your Small Claims case is entirely your choice.

Feel free to call us (305.373.3826) to discuss your Florida Small Claims Court case and how we can help you prepare for the same through our Small Claims consult service.
