In Carnival Corp. v. Woerner, 2D02-5503, (Fla. 2DCA 2003), opinion filed May 14, 2003, the Florida Second District Court of Appeal held that the a forum selection
clause contained in a form cruise ticket contract is enforceable. It was not
persuasive to the Court that the passengers only had a short time to reject the
form ticket contract if the venue provision had been objectionable to them.
Decision relied upon the earlier precedence of Norwegian Cruise Line, Ltd. v. Clark,
28 Fla. L. Weekly D650 (Fla. 2DCA, Mar. 7 2003).
